Terms of Service
Last updated: 4 November 2026
These Terms of Service (“Terms”) govern access to and use of the SpotMyPixel website and related services (the “Service”). By using the Service or completing a purchase, you agree to these Terms, the Content Policy, and the Privacy Policy. If you participate in the affiliate program, the Affiliate Terms also apply.
1. Operator
SpotMyPixel is operated by SM SEAMLESS DIGITAL LTD, a company registered in Cyprus (“SpotMyPixel”, “we”, “us”). Company details are at the end of these Terms; contact details are on the Contact page.
2. Eligibility and capacity
You may use the Service only if you have legal capacity to enter a binding contract and only from a location we currently accept for purchases. Pixel purchases are limited to selected countries and territories and, for the United States and Canada, selected states, provinces and territories. We expand availability progressively as we satisfy the tax and regulatory requirements of each location; a location being listed in our systems does not mean it is open for purchases. Availability is determined server-side, may be suspended at any time (for example when a tax threshold or internal operating limit is approached), and may change without converting an unsupported location into an accepted one. If a minimum age applies in your jurisdiction, you must meet it. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation.
Before checkout we determine your country from your network connection; it cannot be changed. If you are in the United States or Canada you also select your state, province or territory, and you state whether you are buying as a consumer or as a business. If we cannot determine your country (for example behind some VPNs or anonymising networks), checkout is unavailable. We collect a full billing address through Stripe. We compare this location with the billing details Stripe provides after payment, and we may use other supporting location evidence such as the country of your payment card issuer. We use this evidence to confirm eligibility and to determine the tax that applies to your purchase, and we keep it with our accounting and tax records. IP address or network location alone is not treated as definitive proof of residence. We may refuse, cancel, or refund a purchase that is not eligible.
We do not sell to persons or locations subject to applicable sanctions or other legal restrictions, or where our payment provider does not support the transaction, including certain regions within otherwise eligible countries. You must not use another billing country, payment method or intermediary to circumvent these restrictions. We may refuse or refund any purchase that we reasonably believe is restricted.
3. The SpotMyPixel service
SpotMyPixel sells paid digital advertising / display placements on a public canvas. When you complete a purchase, you receive a contractual right to display an image, and optionally a destination link, on a defined rectangular area of the canvas, subject to these Terms, the Content Policy, automated and manual moderation, and continued operation of the Service.
You do not receive an investment, asset, ownership interest, digital real estate, security, commodity, NFT, token, or any right to financial return, resale proceeds, guaranteed appreciation, or ROI. Prices are fees for advertising / display rights, not a valuation of property.
4. Finite canvas
The public canvas is a finite grid of 1,000 × 500 product pixels (500,000 sellable pixels). Coordinates and dimensions are integer product pixels. Once a rectangle is purchased, it remains claimed and is not automatically offered to others, including if the image is later disabled, rejected, or unpublished for policy reasons.
The Service does not currently implement a fixed display expiry for paid placements. Display continues while the placement remains on the canvas and the Service operates, subject to these Terms (including removal, disablement, and interruption).
5. Pricing and payment
Prices are calculated server-side at checkout in US dollars using the pricing then in force and shown on the site (currently: the smallest advertisement is 20×20 pixels for $5.00, and larger advertisements cost proportionally more — $5.00 × width × height ÷ 400, rounded to the cent). Before you are sent to payment we show the final total, including any VAT, GST or sales tax that applies to your location and customer type, and the currency. Payment is processed by Stripe Checkout. We do not store card numbers on our servers. A successful, verified payment creates the claimed placement only if the purchase also passes geographic eligibility checks. Unpaid checkout holds are temporary reservations (default 30 minutes, aligned with Stripe Checkout expiry, and configurable by the operator) and expire if payment is not completed.
If payment succeeds but the billing address or other location evidence shows the purchase is not eligible, we do not publish the pixels and do not create an eligible affiliate commission. We cancel or refund the payment through the payment workflow then in use, subject to Stripe and the payment method. Inventory held for that checkout is released or reconciled. We may refuse unsupported purchases at any time.
5A. Taxes, business customers and invoices
Where VAT, GST or sales tax applies, it is calculated according to your location and whether you buy as a consumer or as a business, and it is either added to the advertised price or included in it, as shown before payment.
Business customers established in the European Union may provide a VAT identification number. We validate it with the European Commission's VIES service. Where it is valid and the reverse-charge mechanism applies, we do not charge VAT and the customer accounts for VAT in its own Member State. If a VAT number cannot be validated at the time of purchase (for example because VIES is unavailable), we do not apply the reverse charge: you can try again later or, where we offer it, expressly agree before payment to continue with VAT charged; we may later re-check your VAT number. Outside the EU we cannot validate business tax registrations; where local tax applies, it is charged only after you agree to it before payment. You must give accurate information about your customer status; you are responsible for any tax consequences of inaccurate information.
Payment documents are issued through Stripe, our payment provider. For every purchase Stripe emails a receipt showing the amount paid and any tax charged. If you buy as a business, Stripe also issues a numbered invoice showing our VAT number, the business name you enter at checkout, your VAT number where it has been validated, the tax charged and, where it applies, the reverse-charge statement. You can open the receipt and invoice from the Stripe email or from the payment confirmation page.
6. No investment, resale, or financial return
Purchases are not transferable through SpotMyPixel as an investment product. We do not operate a resale marketplace, do not promise that placements will increase in value, and do not share advertising revenue with purchasers. Affiliate commissions (if any) are a separate marketing arrangement under the Affiliate Terms and are not a return on a placement purchase.
7. Image and link submission
You must upload a raster image (JPEG, PNG, WebP, or AVIF, subject to size and technical limits shown at upload). We convert accepted uploads to a normalised JPEG for storage, moderation, and public display. Transparent or semi-transparent images are rejected; we do not flatten them onto a background. HEIC/HEIF, SVG, PDF, video, and animated formats are not accepted. You may optionally submit a destination URL. We may normalise URLs (for example by adding https://), follow redirects, scan the destination page, and later re-scan published links. Destination clicks may be sent through a SpotMyPixel controlled redirect (the /go path) rather than the raw URL. We do not guarantee that external sites remain available, safe, or unchanged.
8. Content attestation
Before payment you must confirm that your image and destination link comply with these Terms and the Content Policy. That confirmation is a condition of checkout. You remain responsible for the content you submit and for the destination page at the time of submission and afterwards.
9. Automated moderation
We use automated safety checks, including third-party classifiers and an isolated destination-page scanner, before payment. Ordinary purchases that pass those checks are published after verified payment. Automated moderation is imperfect and may make mistakes, including false approvals and false rejections. A pass is not a warranty that content is lawful or policy-compliant. After publication we may re-scan destination links and disable unsafe or non-compliant links or placements.
10. Intellectual property
You represent and warrant that you own the submitted image or have all licences and permissions needed to display it on SpotMyPixel and to grant the rights in this section. You grant SpotMyPixel a non-exclusive, worldwide licence to host, reproduce, display, and technically process the image and related metadata as needed to operate, moderate, and present the canvas. You remain responsible for third-party intellectual-property claims arising from your content or destination.
11. Prohibited content
You must not submit content or destinations that violate the Content Policy, including sexually explicit material, prohibited nudity, sexual services advertising, malware or phishing, scams, illicit goods or services, hate or extremism, graphic violence, or other prohibited material, or that attempt to evade review through redirects, shortened URLs, cloaking, or misleading links.
12. Manual review, reports, and no refund for policy violations
Automated moderation is not guaranteed to detect every prohibited item. If prohibited or non-compliant content later becomes apparent through manual SpotMyPixel review, public reports, URL re-scan, or other reasonable detection, we may disable the image, remove it from public display, disable or block the destination URL, and/or require that the content not be shown.
If that removal or disablement results from your violation of these Terms or the Content Policy, you are not entitled to a refund merely because SpotMyPixel had to remove or disable the prohibited content, except where required by applicable law. This section does not waive mandatory consumer or other statutory rights that cannot be waived.
After purchase, the email collected by Stripe Checkout may be used to send a one-time login link so you can manage artwork. Image-only replacement is available for placements you paid for: location, size, paid amount, affiliate attribution, and destination URL cannot be changed in that flow. A replacement image is normalised and moderated the same way as a first upload. If we hid the image specifically as a content violation, a replacement that passes the automated check is reviewed by our team before public display is restored, and only when the order remains valid, there is no open payment dispute, and the destination URL is not blocked. Replacing an image does not unblock a blocked destination URL and does not override other administrative disablement.
Operational Stripe refunds or chargebacks, where they occur, do not automatically return the canvas rectangle to inventory.
13. Affiliate and referral disclosure
Some visits may be attributed to an affiliate referral code or link. Optional device storage used for that attribution is described in the Cookie Policy. Purchasing works if you reject optional attribution storage; the affiliate may then not receive credit unless you enter a referral code yourself. Affiliates do not receive purchaser payment-card or Stripe billing identity from SpotMyPixel.
14. Availability and reservations
Selecting pixels does not reserve them until checkout begins. During Stripe Checkout, the selected area is held temporarily. If payment is not completed before the hold expires, the area may become available to others. If payment completes but the area can no longer be allocated to you, we do not publish and we refund the payment in full automatically. We may refuse, delay, or fail closed on checkout when security or moderation checks cannot be completed.
15. Refunds, cancellation and withdrawal
Consumers in the European Union and the United Kingdom. You have the right to withdraw from the contract within 14 days of purchase without giving any reason. At checkout you ask us to start displaying your placement immediately. If you then withdraw within the 14-day period, we refund the amount you paid less a proportionate amount for the display provided up to the time you informed us of your withdrawal. Because the display service continues indefinitely, we do not treat it as fully performed during the withdrawal period. You can withdraw using our withdrawal form or any other clear statement sent to us; we confirm receipt by email and refund to the original payment method within 14 days of receiving your withdrawal. Any VAT included in the refunded amount is refunded proportionately.
Except where required by applicable law, fees are charged for the advertising / display rights described in these Terms, not for a guaranteed outcome, traffic, or continued safety of an external destination. Chargebacks and payment disputes are handled through Stripe and your payment provider. A refunded or disputed order may reverse any related affiliate commission. The purchased rectangle remains claimed unless we expressly decide otherwise.
16. Service interruptions
The Service may be unavailable, delayed, or degraded because of maintenance, hosting issues, third-party outages (including Stripe, email, bot-protection, or moderation providers), or events beyond our reasonable control. We do not warrant uninterrupted or error-free operation.
17. Limitation of liability
To the fullest extent permitted by applicable law, SpotMyPixel is not liable for lost profits, lost data, reputational harm, or indirect, incidental, or consequential damages arising from the Service or a placement. Our aggregate liability arising out of a purchase is limited to the amount you paid for that purchase, except where such limitation is prohibited. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, including (where applicable) liability for fraud or for death or personal injury caused by negligence.
18. Termination and removal
We may suspend or terminate access, disable placements or links, or refuse future submissions where we reasonably believe these Terms, the Content Policy, or applicable law has been violated, or to protect the Service or others. Affiliate accounts may be disabled as described in the Affiliate Terms.
19. Governing law
These Terms are intended to be governed by the laws of the Republic of Cyprus (European Union), without prejudice to mandatory consumer protections that apply in your country of residence. Disputes are intended to be resolved in the courts of the Republic of Cyprus, except where mandatory law requires another venue.
20. Changes
We may update these Terms. The “Last updated” date will change when we do. Continued use after an update constitutes acceptance except where mandatory law requires a different process.
